SALE TERMS

1. NO WARRANTIES: All property is being sold AS IS, WHERE IS, and with all faults. There are no warranties, representations or guarantees, express or implied, as to the quality, character or condition of any of the property. The implied warranty of merchantability is expressly disclaimed. There is no warranty of fitness for a particular purpose. Auction Buyers shall not be entitled to any adjustment or allowance, recession, damages or any other remedy or claim on account of the quality, character or condition of any property purchased.

2. INSPECTION: The Buyer agrees to rely exclusively on his pre-auction personal inspection of the property.

3. RISK OF LOSS: The Buyer takes delivery, takes full responsibility and assumes all risk of loss for all property purchased from the time the Auctioneer accepts the Buyer=s offer (bid).

4. EQUIPMENT REMOVAL: Except as otherwise stated on the Auction Invoice, the Buyer agrees to remove all purchased property from the Auction Site in accordance with Auctioneer=s removal terms.

5. SETTLEMENT: The United States and State Laws and Penalties for failure to settle and pay shall apply. The Buyer agrees to make complete settlement on all purchases by wire transfer within 1 business day from the date of the Auction.

6. DEPOSIT: A deposit check of 25% of the total bid is enclosed. If my bid is successful, the balance will be sent by wire transfer to DeMott Auction Company, Inc. If the bid is unsuccessful, the deposit check will be voided and returned to the Buyer.
